In order to enter into a contract a sale must be made by you, we must receive payment of the total price for the services we provide before your order can be accepted. Total payment of the price for the services provided, represents a contract offer on your part to purchase the requested service. Only at this point will this be a legally binding contract created between us. You are fully and finally responsible for a purchase made through this website by clicking the submit button. This in effect means that you are entering a 12-month contract.
Acknowledgement of Your Order. To enable us to process your order, you will need to provide us with certain information details, for example your name, address, telephone number, e-mail address and any other information relevant to your business, trading hours, business telephone contacts, social media contacts etc., all relevant details for your new website. We will notify you by e-mail as soon as possible to confirm receipt of your order and confirm details by way of an invoice. However, this correspondence does not and will not constitute a contract between us.
Ownership of Rights. All rights, including copyright, are owned by or licensed to Driving School Websites
Descriptions and Accuracy of Product Information Content. We endeavour to describe the content of services provided in this website, to ensure that the descriptions and prices quoted are correct at the time of publishing as accurately as possible, no claim can be made for any errors or mis-interpretations on your behalf, the onus will be on the reader to question any, or all aspects, prior to entering a contract with us.
Payment Terms. When you click "submit your order" your account will be debited for the price of the services and payment delivery by your chosen method and payment processor, i.e. Pay Pal, Revolut, which are secure payment options and as such you enter a contract with them to pay us for your order. We do not see your personal payment detail other than a notification that you have paid through your preferred secure payment, only after being credited with such payment along with an instruction from them to deliver to you, it is at this point your contract reverts to us to deliver the service. Note: If it’s not possible after reasonable notification to obtain full payment for the services provided to you, we can refuse to develop, design or maintain the services to your website. Failure to make required payments or renewals effectively breaks the contract between us and we can cease providing the service, essentially taking you offline. This does not affect your rights however, in this case no liability financial or otherwise, rests with us.
EU Distance Selling Directive. In accordance with the EU distance selling directives, a consumer has the right to cancel with full refund any new services purchased from us within 14 days of us acknowledging your order, or with 14 days of us commencing to provide the requested service (whichever is the later). An exception to this is in the case of personalised products such as, your personalised website, once commenced or completed, this includes a domain name registration (even and including misspellings, unless the fault rests with us) . This is where the domain requested by you has already been registered on your behalf, or issued SSL certificate where your domain or server name is encoded. Bespoke websites and domain names and SSL certificates are considered 'customised' services, they cannot be undone or reused by others, so the fees are non-refundable in this instance.
Cancellation by Us. We reserve the right not to process your order if in our opinion the website is inappropriate or illegal, we do not deliver to your regional area or country. Any additional costs which apply to your destination, or other, thereafter we will not process your order for the above reasons, and we will notify you by e-mail and will re-credit to your account any sum deducted less any payment service handlers fees as soon as possible. We reserve the right in our absolute discretion to refuse any order placed through our website. If we refuse an order, we will advise you of why we have done so by email or telephone and authorise an immediate refund of your payment.
Liability. No responsibility can be borne by us for any downtime on a website for any reason financial or otherwise, as we operate in partnership with website platforms and hosting companies, we do not accept liability, if we are prevented or delayed from complying with our obligations as set out in these terms and conditions by anything our service providers, you or anyone acting for you with your express or implied authority, does or fails to do, or is due to events which are beyond our control. Furthermore, we do not accept liability for any losses related to any business, including but not limited to, lost data, lost profits, lost revenues, missed domain renewals or any other form whatsoever in whole or part of business interruption.
Indemnification. You agree to defend and indemnify and hold harmless Driving School Websites, our owners, affiliates, officers, directors, partners, sub-contractors, employees and legal representatives for any loss, liabilities, damages, costs or expenses including legal fees, resulting from a claim including any third party claim arising from any related or unrelated claim for the use of connection, any downtime access to or from the website services, any loss of service, domain registration or re-registrations, use of the domain name, your website content, typographical errors, or mis-interpretations, or for any breach or violation by you, of the terms and conditions as specified throughout.
Domain Search Facility. In an effort to provide you with a new domain name, we offer a search facility on your behalf. To check if a particular domain name is already registered. This facility is provided for purposes of elimination only and does not indicate that a particular domain name will be available for registration, or that such a registration will be successful. We operate upon results returned to us. It must be noted that this is generated from information outside of our control and is issued to you in good faith, however this information may be outdated and/or inaccurate and that no liability whatsoever attaches to us in respect of any loss or damage caused by the use of or reliance upon this information. The actual availability for registration of a domain name will be determined only when the order is placed and confirmed by/with the relevant registry or registrar.
Damage to Your Computer or Communication Equipment. We try to ensure that or any new website is free from viruses or defects. However, we cannot guarantee that your use of this website or any website accessible through it will not cause damage to your computer. Therefore, we will not be held liable to any person or entity, for any loss or damage which may arise to computer or any form of communication equipment as a result of using this website. It is your responsibility to ensure that the right equipment is available to use the website with the exception in the case of negligence on our part or the part however negate responsibility for the services provided by our service providers.

Third Party Rights. Nothing in this agreement is intended to, nor shall it confer any rights on any third party.
Domain Transfers. Allow you to move your domain registration from one provider to another. Domain transfers may generally only be initiated by the domain holder, or you may authorise us. By doing so you will need to provide certain information, such as passwords, this should not be undertaken by email. If you have recently purchased a website domain, please note that some domains cannot be transferred within a specific period of time of initial registration or of a previous transfer. For example, .com, .net, .org and most other gTLD's cannot be transferred within 60 days of registration or of a previous transfer.
Names Available Today May Not Be Tomorrow. Domain registrations is not performed in real time, so we cannot guarantee that any registrations will be successful until such time as they are processed and completed and the domain displays as registered. In the case of dot.ie and other managed top-level domains, you may have to conform to specific registration policies and provide adequate supporting documentation to support your application. Please note that a non-refund policy applies to domain registrations and transfers that we could not complete because of a failure to provide authorisation or correct supporting information by you.
Domain Parking. Not ready to set up your website yet. We provide a service to register a domain name and we will park a domain until you are ready, providing a minimal fee for domain parking is paid generally within a 12-month period. This parking subscription may provide a publicly viewable domain parking web reservation page, with or without your company name, for example "www.yourbusiness.com Website Under Construction! or "Coming Soon" etc., so that you can verify that the domain is working.
All Websites Carry a 12 Month Contract. All websites carry a 12-month contract, this essentially means that once purchased, you enter a 12-month contract with us and we with our suppliers of this service, therefore no refunds are offered to us, subsequently is this no refund policy which out of our control.
Expiring Domain Names. For expiring domain names, you will receive an additional reminder notice 30 days before the expiry of the domain. If payment is not received by the expiry date, our service providers and ourselves, reserve the right to suspend or terminate services with immediate effect. No responsibility can be born by us for any loss whatsoever or for any reason, you are wholly responsible for your domain re-registration.
Please remember that renewal of domain names cannot be guaranteed after the expiry date and note that some top-level domains will incur additional fees for reactivation, once they have expired.
Data Protection. If you are an individual using our services, your personal information will be protected in accordance with the General Data Protection Regulation (GDPR) and Irish law.
Privacy Statement. If you are a business or other organisation using our services, you may be acting as a Data Controller in respect of personal information you give to us or place on our systems relating to data subjects that are employees, customers etc., Please ensure that you comply with any data processing laws, as requested information to be included in any new website being built for you is at the owners responsibility and no responsibility will be accepted by Driving School Websites and you agree that any information requested is authorised and is hereby incorporated into these terms and conditions.
